Can I Fly with Cbd?

As readers of our legal blog know, we post about criminal law topics often. Recently, we discussed whether TSA could arrest you for drugs. However, in that Springfield, Illinois, bog post, we did not discuss CBD.

Not the TSA’s job

For context, Transportation Security Administration officers do not necessarily care about drugs. They are not looking for drugs, and they only deal with drugs when they find them incidental to their searches for dangerous items. The TSA dogs you see walking through the airport are not even trained to sniff out drugs.

CBD?

Cannabidiol, commonly known as CBD, is a chemical extracted from marijuana. However, it does not cause its users to get “high.” However, this depends on the amount of THC in the CBD. THC is the chemical that causes marijuana users to feel a high.

Can I fly with it?

Yes. The U.S. Food and Drug Administration approved CBD products, but only if it contains less than 0.3% THC. As such, as long as your CBD product meets this requirement, you can fly with it as it is not illegal. If it has a higher THC percentage though, it is technically illegal. In addition, if the CBD product is a liquid, it must be less than 3.4 ounces to legally fly.

It may not matter in practice

Nonetheless, remember that TSA officers are not looking for illegal drugs. As such, even if the THC percentage is higher than 0.3%, they may not care or even check. This can be the same situation for edibles too, if the packaging does not make it obvious.

But, remember, illegal is still illegal, and you could face consequences if you are in a state where whatever you have on you is illegal. If you face this situation, you will need to contact your Springfield, Illinois, attorney.
