What First-Time Underage Dui Offenders in Illinois Can Expect

Illinois has strict laws on drinking and driving – especially for anyone under the age of 21. Knowing what to expect should you or someone you know find themselves in this situation will help you prepare and build a defense.

Zero tolerance for underage DUI in Illinois

If you are over 21 years old and have a blood alcohol concentration below 0.08%, you don’t have to worry about getting a DUI charge. Sadly, different rules apply if you are still underage.

The state’s Zero Tolerance Law regarding drunk driving for minors means that if you have any amount of alcohol in your system while driving, you receive a DUI charge. As a first-time offender, you can lose your driving privileges for three months as long as your BAC level is over zero.

What to do if you are stopped for suspected DUI

If a police officer pulls you over for suspected drunk driving, it’s always best to comply. Hold back from arguing with them. It doesn’t matter if you know you are sober enough to drive. As long as your BAC levels register anything over zero, even if it’s just 0.01%, you may still get a DUI charge.

Most importantly, make sure you comply with the officer’s request to take a breathalyzer or field sobriety test. Refusal to take a drunk driving test can get you a six-month-long suspension from driving if it is your first violation.

Penalties for a DUI conviction

A DUI conviction can significantly affect your education and your future. If you are unable to defend yourself or negotiate a lighter sentence, a DUI conviction can result in the following penalties:

  • Suspension of driving privileges for at least two years
  • Prison time of up to a year
  • Fines of up to $2,500

Additionally, the authorities can order you to install a Breath Alcohol Ignition Interlock Device (BAIID) on your car to check your BAC levels each time you drive.
